Association Type 1901

Une association est, selon la loi du 1er juillet 1901, une convention en vertu de laquelle deux personnes au moins décident de partager leurs connaissances et/ou leur activité dans un but autre que le partage des bénéfices ou la recherche de profit. Ainsi, elle se distingue d’une société classique (SAS, SASU, SARL, SCI).

C’est la loi du 1er juillet 1901 susvisée qui fixe le cadre juridique de l’association type loi 1901. Ce texte dispose que l’association est, par principe, à but non lucratif.

Ainsi, il est impossible de créer une association à but lucratif : cela entrerait en contradiction avec les principes généraux régissant le régime juridique de l’association. Si les membres de l’association recherchent le profit, il sera préférable de se tourner vers la création d’une société.

An association is, according to the law of 1 July 1901, an agreement by virtue of which at least two people decide to share their knowledge and/or their activity for a purpose other than the sharing of profits or the search for profit.

Thus, it is different from a classic company (SAS, SASU, SARL, SCI).

It is the aforementioned law of 1 July 1901 that sets out the legal framework for the 1901-type association. This text stipulates that the association is, in principle, not-for-profit.

Thus, it is impossible to create a profit-making association: this would be in contradiction with the general principles governing the legal regime of the association. If the members of the association are seeking profit, it would be preferable to create a company.
